Description:The Trademark Legal Coach iPhone/iPod application is a quick reference for business owners and individuals engaged in commerce to understand trademark registration, rules, and statutes.
The full trademark statute (Title 15 of the United States Code) is provided as a guide to the United States trademark system.
A "Registration Guide" was designed to highlight the most important aspects of registration that include (1) the basics, (2) classification, (3) application, (4) drawing, (5) specimens, (6) renewals, (7) fees, (8) the two registers, (9) service marks, and (10) infringement.
The United States Code (USC) is supplemented with the Code of Federal Regulations (CFR), which provides specific details pertaining to statutory provisions. 37 CFR part 2 is referred to as the "Rules of Practice in Trademark Cases". Selected sections of the CFR are included in the "Registration Guide" to fully explain the registration process.
For example, 15 USC 1051 states that the applicant shall submit the number of specimens as required by the Director. 37 CFR 2.56 defines what is a specimen (i.e. label, tag, or container for the goods, or a display associated with the goods) and the size limits.
The classification schedule lists the different groups that all trademark registrations are categorized. The CFR explains distinctiveness of a term, and the USC outlines what cannot be registered for federal protection. A drawing and description are required if the mark is not printed using standard characters. The renewal process includes multiple documents at designated times.
This iPhone/iPod application was created for users to easily move between different parts using three tabs that saves the last textual display. For instance, the user can open the "Registration Guide" to read the CFR provision pertaining to distinctiveness. He/she can then open the "Full Statute" to read the statutory section about registration requirements. The tabs could then be flipped back-and-forth to read both at the same time.
For purposes of a mobile device, the navigation menu titles are abbreviated and paraphrased to fit on the screen. Full titles are listed in the textual display when an item is touched. The full display was formatted to maximize the small device screen.
Trademark Legal Coach was designed and created by Michael Elliot Byczek, a licensed attorney in the State of Illinois and formally trained computer science professional. His consulting company in Chicago assists business owners obtain a trademark as a legal coach.

Users should always check the most current laws and fees from the United States Patent and Trademark Office. The information contained in this software is current as of December 26, 2008 subject to recent amendments that the government may not have incorporated into the official statute. For example, the Enforcement of Intellectual Property Rights Act of 2008 (P.L. 110-403) was signed into law on October 13, 2008. However, the official statute was not updated as of December 26th. The Trademark Legal Coach includes the amendments of P.L. 110-403.
